Terms of Use
By accessing our website, attending our events or joining our community, you agree to these Terms of Use. Please read them carefully. These terms are governed by the laws of New South Wales, Australia.
1. About Foundera
Foundera is a youth platform and movement based in Sydney, New South Wales, Australia. We provide events, mentoring, workshops, online community access, and educational resources for young Australians aged 17 to 25, including founders, corporate climbers and students.
These Terms of Use ("Terms") govern your use of the Foundera website (foundera.com.au), our events, community platforms and any related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Platform.
2. Eligibility
The Platform is primarily designed for individuals aged 17 to 25 residing in Australia. By using the Platform, you represent that:
- You are at least 17 years of age, or have the consent of a parent or guardian if under 18
- You have the legal capacity to enter into a binding agreement
- You will comply with these Terms and all applicable laws
If you are under 18 years of age, a parent or guardian must review and agree to these Terms on your behalf.
3. Your Account and Registration
Some features of the Platform (including community access) may require you to register an account. When registering, you agree to:
- Provide accurate, current and complete information
- Maintain and promptly update your information to keep it accurate
- Keep your login credentials confidential and not share them with others
- Notify us immediately at team@founderaa.com.au if you suspect unauthorised use of your account
You are responsible for all activity that occurs under your account.
4. Acceptable Use
When using the Platform, you agree not to:
- Violate any applicable Australian federal, state or territory laws or regulations
- Post, share or transmit content that is defamatory, offensive, harassing, threatening, discriminatory or otherwise harmful
- Impersonate any person or misrepresent your affiliation with any organisation
- Engage in spam, phishing or unsolicited commercial communications in breach of the Spam Act 2003 (Cth)
- Upload or transmit malware, viruses or other harmful code
- Attempt to gain unauthorised access to any part of the Platform or any connected systems
- Scrape, crawl or otherwise harvest data from the Platform without our express written permission
- Use the Platform for any unlawful, fraudulent or commercial purpose not expressly authorised by us
- Reproduce, distribute or create derivative works from our content without written permission
We reserve the right to suspend or terminate your access to the Platform if you breach these acceptable use requirements.
5. Events
5.1 Registration and attendance
Event registrations may be required in advance. We reserve the right to refuse entry or remove any individual from an event for any lawful reason, including breach of these Terms or our Code of Conduct.
5.2 Photography and recording
By attending a Foundera event, you acknowledge that photographs, video and audio recordings may be taken during the event and may be used by Foundera for promotional, educational and marketing purposes. If you do not wish to be photographed or recorded, please notify us in advance or at the event.
5.3 Cancellations
Foundera reserves the right to cancel, postpone or change the format of any event. Where an event is cancelled by Foundera, we will use reasonable endeavours to notify registered attendees promptly.
5.4 Code of Conduct
All event attendees are expected to treat others with respect and professionalism. Harassment, discrimination or intimidation of any kind will not be tolerated and may result in removal from the event and/or the Platform.
6. Intellectual Property
All content on the Platform, including but not limited to text, graphics, logos, icons, images, audio and software, is owned by or licensed to Foundera and is protected under the Copyright Act 1968 (Cth) and applicable intellectual property laws.
You must not reproduce, distribute, adapt, publicly display or create derivative works from any content on the Platform without our prior written consent, except as permitted by law (e.g., fair dealing under the Copyright Act 1968).
By submitting content to the Platform (such as applications, forum posts or event feedback), you grant Foundera a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content for the purposes of operating and promoting the Platform.
7. Australian Consumer Law
Our Platform and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL), Schedule 2 of the Competition and Consumer Act 2010 (Cth). Nothing in these Terms is intended to limit or exclude any rights you may have under the ACL.
Where we supply services, you are entitled to the consumer guarantees set out in the ACL, including that services will be provided with due care and skill and be fit for the purpose for which they are supplied.
8. Disclaimer of Warranties
To the maximum extent permitted by law (and subject to any non-excludable consumer guarantees under the ACL), the Platform is provided on an "as is" and "as available" basis. We do not warrant that:
- The Platform will be error-free, uninterrupted or secure
- Any information or content on the Platform is accurate, complete or current
- The Platform will meet your specific needs or requirements
Content on the Platform is provided for general informational purposes only and does not constitute legal, financial, career or other professional advice.
9. Limitation of Liability
To the maximum extent permitted by law (and subject to your non-excludable rights under the ACL), Foundera and its operators, employees and partners will not be liable for any loss or damage, whether direct, indirect, incidental, special or consequential, arising out of or in connection with:
- Your use of, or inability to use, the Platform
- Reliance on any content or information provided on the Platform
- Attendance at a Foundera event
- Any third-party content, products or services linked from the Platform
Where liability cannot be excluded under Australian law, our liability is limited (at our option) to re-supplying the relevant service or paying the cost of having the service re-supplied.
10. Third-Party Links and Platforms
The Platform may contain links to third-party websites or services (e.g., Skool, LinkedIn, social media platforms). These links are provided for your convenience only. We do not endorse, control or take responsibility for the content, privacy practices or terms of any third-party platform.
Your interactions with third-party platforms are governed by their own terms and privacy policies.
11. Privacy
Your personal information is handled in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). By using the Platform, you acknowledge and consent to the collection, use and disclosure of your personal information as described in our Privacy Policy.
12. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised "Last updated" date. We encourage you to review these Terms periodically.
Your continued use of the Platform after we post updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Platform.
13. Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, for any reason including breach of these Terms. Any provisions of these Terms which by their nature should survive termination will do so, including intellectual property, limitation of liability, and governing law.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.
We encourage you to contact us in the first instance if you have a dispute. Many issues can be resolved quickly and informally. If we cannot resolve a dispute by negotiation, either party may seek resolution through:
- Mediation through a recognised Australian dispute resolution body
- The courts of New South Wales or the relevant Australian federal court
Nothing in these Terms prevents you from exercising your rights under Australian Consumer Law or other applicable legislation.
